Terms of Service

By accessing or using FR-APIaaS, you agree to be bound by these Terms of Service. If you access FR-APIaaS on behalf of an organization, you represent that you have authority to bind that organization to these terms.

These terms are effective as of April 2026. Continued use of the service after that date constitutes acceptance of the current terms.

FR-APIaaS provides face recognition infrastructure, including face enrollment, verification, identification, and liveness detection, to software developers and business customers ("Customers").

FR-APIaaS operates as a data processor, not a data controller, with respect to biometric data submitted by your end users. You, the Customer, act as the data controller and are responsible for establishing a lawful basis for processing and obtaining any required notices or consents from your end users.

• You must provide accurate, current, and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your credentials and API keys.
• You must notify us immediately at security@fr-apiaas.io if you suspect unauthorized access to your account.
• You may not share your account credentials with third parties or create accounts on behalf of others without authorization.
• Each account may only be used by the registered individual or organization.

You agree not to use FR-APIaaS to:

• Conduct illegal surveillance, tracking, or monitoring of individuals without their knowledge or consent.
• Enroll biometric data of children without verifiable parental or guardian consent.
• Scrape, aggregate, or identify individuals in public spaces for any unauthorized purpose.
• Reverse-engineer, decompile, or attempt to extract the underlying face recognition models or algorithms.
• Resell, sublicense, or white-label the API without a separate reseller agreement.
• Attempt to circumvent rate limits, access controls, or security measures.
• Use the service in any manner that violates applicable laws, including biometric privacy laws in your jurisdiction.

Violations of the acceptable use requirements may result in immediate suspension without notice or refund.

• Paid subscriptions auto-renew at the end of each billing period unless cancelled.
• No refunds are issued for partial billing months. If you cancel mid-month, your plan remains active until the end of the current period.
• We reserve the right to suspend your account if a payment is overdue by more than 7 days. Data is retained for 30 days after suspension before deletion.
• All payments are processed by Stripe. FR-APIaaS does not store your card details directly.
• Prices are listed in USD and may be subject to applicable taxes depending on your jurisdiction.
• We reserve the right to change pricing with 30 days notice. Price changes do not apply to existing billing periods in progress.

You retain full ownership of all data you submit to FR-APIaaS, including face images, embeddings, and associated metadata.

• We process your data solely to provide the service as described in our Privacy Policy and Biometric Data Privacy Policy.
• We do not use your data to train our models without your explicit written consent.
• Upon account termination, all biometric data (face embeddings and stored images) is permanently deleted within 30 days.
• You may export or delete your data at any time via the API or dashboard.

We target 99.9% uptime for the FR-APIaaS API. Formal SLA commitments are not included with the Free or Starter tiers.

• Scheduled maintenance windows will be announced at least 24 hours in advance via our status page.
• FR-APIaaS is not liable for data loss, revenue loss, or service interruptions caused by infrastructure failures beyond our direct control (e.g. cloud provider outages).
• Pro and Enterprise customers may request SLA addendums with uptime commitments and remediation credits.

FR-APIaaS retains all intellectual property rights in the platform, including the API, dashboard, underlying models, algorithms, and documentation.

Your data, including face embeddings derived from submitted images, remains yours. Your application code, models, and business logic also remain yours. Nothing in these terms grants FR-APIaaS ownership of your intellectual property.

To the maximum extent permitted by applicable law, FR-APIaaS's total cumulative liability arising out of or relating to these terms or the service is limited to the fees you paid in the 3 months immediately preceding the claim.

FR-APIaaS is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

• Either party may terminate the agreement with 30 days written notice.
• We may terminate or suspend your account immediately and without notice for material violations of these Terms, including but not limited to: illegal use, non-payment, or actions that endanger the security or stability of the platform.
• Upon termination, your access to the service ceases. Your data will be retained for 30 days before permanent deletion, during which time you may request an export.

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms.

Non-material changes, such as clarifications or typographical corrections, may be made without notice. The "Last updated" date at the top of this page reflects the most recent revision.
